WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AND PERMISSION OF USE AGREEMENT  L and J Watkins, LLC, d/b/a The Ship Yard provides facilities and equipment for use in baseball and softball recreational activities for use by participants, including batting cages, pitching machines, pitching mounds, protective cages, bats, balls, helmets, and other related equipment. For purposes of this agreement, L and J Watkins, LLC, d/b/a The Ship Yard, shall mean L and J Watkins, LLC, d/b/a The Ship Yard, and any and all affiliated entities, including but not limited to L and J Watkins, LLC, d/b/a The Ship Yard, and their respective successors and assigns, officers, directors, and members, employees, officials and agents, and the premises used by L and J Watkins, LLC, d/b/a The Ship Yard.  In consideration of being allowed to be present at and participate in any way in the activities at L and J Watkins, LLC, d/b/a The Ship Yard, I, the undersigned, on behalf of myself, any minor listed on the signature page of this agreement, and each of our respective personal representatives, heirs, next of kin, spouse, and assigns, (hereinafter “I”, “me”, “my”) acknowledge and agree, as follows:  ASSUMPTION OF RISK  I understand that baseball and softball are physical activities that by their very nature carry certain inherent risk of injury that cannot be eliminated regardless of the care taken to avoid injuries. The use of L and J Watkins, LLC, d/b/a The Ship Yard facilities and equipment involves close encounters with solid, fast, moving objects and projectiles, such as bats and hard balls. The use of L and J Watkins, LLC, d/b/a The Ship Yard facilities and equipment during these activities does not guarantee my safety. Even with the use of protective equipment, injuries relating to this type of activity may still occur as a result of factors outside of L and J Watkins, LLC, d/b/a The Ship Yard control. I also understand that, while cleaning procedures may reduce their presence, natural pathogens, including, but not limited to bacteria, viruses, mold, and mildew may be present and that I may be exposed to natural pathogens that may cause me illness, or other bodily injury. I understand and agree that L and J Watkins, LLC, d/b/a The Ship Yard provides baseball and softball facilities and equipment in an as is condition, without warranty, or guarantee that specific facility or piece of equipment will eliminate a participant risk for injury, or the specific facility or piece of equipment has been inspected or tested by L and J Watkins, LLC, d/b/a The Ship Yard prior to each individual participants use. I have read the previous paragraphs, and I know, I understand, and I appreciate these inherent risks. I hereby assert that my participation in the use of L and J Watkins, LLC, d/b/a The Ship Yard, facilities and equipment is voluntary, and then I knowingly and intentionally assume all such risks. I agree to comply with all of work and safety, rules, procedures, and requirements, including but not limited to wearing protective gear. I understand the failure to comply may result in L and J Watkins, LLC, d/b/a The Ship Yard terminating my use of the facilities and equipment requiring me to leave the premises.  WAIVER, INDEMNIFICATION AND HOLD HARMLESS  I hereby voluntarily release, waive, forever discharge, and agree to indemnify and hold harmless L and J Watkins, LLC, d/b/a The Ship Yard, and any and all affiliated entities, including but not limited to L and J Watkins, LLC, d/b/a The Ship Yard, and their respective successors and assigns, officers, directors, and members, employees, officials and agents, and the premises used by L and J Watkins, LLC, d/b/a The Ship Yard from any and all liability for any and all claims, demands of causes of action which are in any way connected with my participation in this activity or my use of L and J   Watkins, LLC, d/b/a The Ship Yard equipment or facilities. I hereby certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in these activities or alternatively I agree to bear the cost of such injury or damage myself. I further certify that I have no medical or physical conditions, which could interfere with my safety in this activity, or else I am willing to assume and bear the costs of all risk that may be created, directly or indirectly, by any such condition. I agree to reimburse L and J Watkins, LLC, d/b/a The Ship Yard for all cost, expenses or fees, or damages incurred by L and J Watkins, LLC, d/b/a The Ship Yard, including damages, to facility and equipment, rising out of my conduct, or the conduct of any minors, and guess that accompany me.   PERMISSION FOR USE OF IMAGE, COMMON NAME, AND STATEMENTS  I understand that L and J Watkins, LLC, d/b/a The Ship Yard, as part of its general operation of a business, maintain photographs and video of participants using the facilities and equipment. I grant permission to use my name, likeness, image, photographic image, video, or graphic image to L and J Watkins, LLC, d/b/a The Ship Yard.  I expressly agree that the foregoing is intended to be as broad and as inclusive, as is permitted by applicable law, and if any portion there of his held invalid, it is agreed that the balance shall remain in full legal force and effect.  I agree that this document shall remain in full force and effect for this visit and for all future visits, unless it is revoked, in writing, by me.  I HAVE HAD SUFFICIENT TIME TO READ THIS ENTIRE DOCUMENT. I HAVE READ AND UNDERSTOOD IT, AND I AGREE TO BE BOUND BY ITS TERMS.
